丹麥一家夜店老闆拒絕招待難民,他該被判刑嗎?
夜店老闆Rafi Ibrahim接受《哥本哈根郵報》(Copenhagen Post)訪問時,提到:「許多來丹麥尋求庇護的難民,週末出來玩時,不懂規矩。」
「他們一看到女生就發狂,會亂摸或抓人家的衣服。」Ibrahim本身也是來自敘利亞的移民,他已在丹麥居住多年,事業有成了。
另一方面,要是你好心想提醒這些新來的年輕人,他們的行為不合乎這裡的社會規範,你會說阿拉伯語系的語言嗎?你的厄利垂亞語怎麼樣?普什圖語?達利語?庫爾德語呢?
跟大多數歐洲人一樣,丹麥夜店老闆Tom Holden Jensen會說很多種語言,但不會說以上那幾種。
所以Jensen拒絕招待不會說丹麥語、德語、或者英語的男性移民。他說這是為了安全考量,怕他們不懂員工的指示。
不過,丹麥是個自由主義的國家,法律規定接納外來移民。因此要是Jensen的夜店不對所有人開放,他可能會面臨六個月的牢獄之災。
Jensen對於旁人指控他有外族恐懼症怒不可遏,他已不在乎別人怎麼講了。他表示,他的夜店從1997年就有「語言規定」了,這不是種族歧視。
Jensen也提到文化差異的問題,舉出夜店保鑣的說法,指這些新移民不懂,女生對他微笑,不表示邀請他「上床」。
大部份反歧視法案都利大於弊,但這次恐怕很難說了。語言測試是種族歧視嗎?那麼荷蘭某些賣大麻的咖啡店,只准荷蘭國民進入,這又有什麼分別?你支持Jensen老闆的立場嗎?

Should a Danish nightclub owner be penalized for banning migrants?
Here’s the problem, according to a Copenhagen Post interview with local nightclub boss Rafi Ibrahim: ‘Many of the refugees and asylum seekers who go out at the weekend do not know the rules. When they see a girl, they go crazy, trying to grope her or grab her clothes.’”— Ibrahim is himself an immigrant from Syria who’s lived and has apparently prospered in Denmark for several years now.
Here’s another problem: let’s say you’re a kind fellow who honestly wants to help these young men understand their behavior is unacceptable. Do you speak any of the multiple variants of Arabic? How’s your Eritrean? Pashto? Dari? Um … Kurdish?
Like most Europeans, Danish club owner Tom Holden Jensen here speaks a lot of languages, but none of the ones we just listed.
So Jensen banned migrant men who can’t speak either Danish, German or English from his club, saying it’s a safety issue as they can’t understand his staff’s instructions.
Denmark, however, is a rather liberal country with laws demanding tolerance … and if Jensen doesn’t re-open his establishment to all, he could face six months in jail.
So be it, says Jensen, who bristles at any suggestion he is some sort of xenophobe. Jensen says his club ‘language rule’ has actually been in place since 1997 and is not racist.
Jensen also touched on cultural differences, noting security staff say the men don’t understand that a smile from a woman isn’t necessarily an invitation to ‘bed’ her.
Most anti-discrimination laws do more good than harm we reckon, and this one’s a tough call. Is a language test racist?
